1. Seller

2. Scope
These General Terms of Sale apply to any sale of the TBG-Chip module to individual (consumer) and professional clients, in France and within the EU/EEA, through an application-based access process. They take precedence over any other document, unless expressly waived in writing by the Seller. The Terms of Use govern the use of the site and the product, the Privacy Policy governs data processing, and the Responsible Use page outlines safety/legal rules.
3. Product & compatibility
TBG Chip is a hardware module that extends Tesla vehicle functionalities, with non-destructive, reversible installation when performed according to the manual. Compatibility depends on the model, firmware, and configuration (e.g., Model 3/Highland, Model Y/Juniper, S/X MCU2/AMD). Performance and Plaid versions are not compatible with power increase. Performance values are indicative (SoC, temperature, tires, etc.).
3.1 Aftermarket Automotive Technology and Product Classification
TBG Auto is an independent provider of aftermarket automotive technology, specializing in vehicle performance software, hardware, electronic modules, and related automotive enhancement solutions.
Our products are designed to modify, enhance, or customize certain vehicle functions, performance characteristics, and electronic systems. These aftermarket solutions are developed independently of the vehicle manufacturer and are not original equipment manufacturer (OEM) components.
3.2 Manufacturer Approval and Certification
Unless expressly stated otherwise, TBG Auto products are not manufactured, tested, approved, certified, or validated by Tesla, Inc. or any other vehicle manufacturer.
TBG Auto does not represent or imply that its products carry official manufacturer certification, authorization, or endorsement.
4. Order process (application-based access)
Application: the customer submits a request.
Evaluation: the Seller, at its sole discretion, selects eligible applications.
Payment link: if accepted, a link is sent, valid for 72 hours.
Conclusion: the sale is completed upon confirmation of full payment.
The Seller may refuse or cancel any order in case of serious doubt (fraud, non-compliance, unavailability).
5. Price, taxes & currencies
Prices are indicated in euros (€), VAT included for B2C sales in France (at the applicable rate), excluding delivery costs. For the EU and exports, VAT treatment follows the applicable scheme (OSS, B2B reverse charge, non-EU export). Any applicable import duties and taxes (outside the EU) remain the responsibility of the customer.
6. Payment
Payment is made through the methods offered within the secure link (card, etc.). The link is valid for 72 hours; if payment is not completed within this period, the reservation is released. The Seller retains ownership of the products until full payment is received (retention of title).
7. Delivery & transfer of risk
Shipping within France/EU takes 3–5 business days after payment, unless pre-ordered or otherwise stated.
Consumers (EU): risk transfers upon taking possession.
Professionals: risk may transfer upon handover to the carrier according to the agreed Incoterm.
The customer must inspect packages upon delivery and file specific reservations with the carrier within the legal deadlines.
8. Right of withdrawal (EU/UK consumers)
You have 14 days from receipt to withdraw without giving any reason.
To exercise this right: notify the Seller (by email) and return the product within 14 days in its new, complete condition, not installed and not activated.
Return costs are the responsibility of the customer.
A reduction may apply if handling exceeds what is necessary to establish the nature and proper functioning of the product (up to 100% if activation/alteration renders the item unsellable as is).
Refund within 14 days after recovery/proof of shipment, via the original payment method.
The right of withdrawal does not apply to professionals.
9. Returns outside the withdrawal period
Any return outside the legal framework requires the Seller’s prior approval and may incur refurbishment/handling fees.
10. Warranties
10.1 Legal warranties (EU consumers)
Legal guarantee of conformity: 2 years from delivery (Art. L217-3 et seq. French Consumer Code).
Guarantee against hidden defects: Art. 1641 French Civil Code.
These guarantees apply independently of the commercial warranty below.
10.2 Seller’s commercial warranty
The module is covered by a 12-month warranty against manufacturing defects (parts and/or replacement), excluding: misuse, improper installation, alteration/modification, damage caused by non-supplied accessories, power surges, liquids, or impacts.
Procedure: prior contact at contact@tbgauto.com; diagnostic; possible return for inspection; repair/replacement or refund at the Seller’s discretion. Shipping costs may remain the customer’s responsibility depending on the case.
This commercial warranty is provided in addition to, and does not affect, your statutory rights under EU Directive 2019/771 and applicable national law.
11. Tesla updates & feature availability
Tesla may release software updates that temporarily affect certain functions. The Seller provides OTA fixes to restore compatibility, without any guarantee of timing. Function availability may vary depending on the vehicle’s firmware and configuration. The Seller does not guarantee the continued availability of functions dependent on third-party ecosystems.
12. Responsible use & legality
⚠️ Legal disclaimer – Strictly limited use
The products and features offered by tbgauto.com are expressly and exclusively reserved for private use off public roads or within the framework of automotive competition. They are not approved by car manufacturers or insurers.
Modifications or uses resulting from these products may lead, without guarantee of completeness, to the total or partial loss of the manufacturer’s warranty, as well as refusal of coverage by certain insurers, unless explicitly agreed upon in advance between the customer and their insurer.
These products are neither designed nor approved for use on public roads. Their activation or use in a vehicle circulating on public roads, including by a passenger, is not recommended and is the sole responsibility of the user.
The purchaser expressly acknowledges having read the specific characteristics of the products as well as the risks associated with their use and assumes full responsibility for any use outside the defined framework.
tbgauto.com disclaims all liability in cases of:

use not compliant with applicable regulations,

challenge to or loss of manufacturer’s warranty,
-
refusal or lack of coverage by the insurer,

fines, administrative sanctions, or penalty points on the driving license,
-
accidents or material, bodily, or intangible damages resulting from non-compliant use.
13. Liability & limitation
To the extent permitted by law, the Seller shall not be held liable for indirect damages, loss of business, data, or use, nor for the consequences of non-compliant use. The Seller’s total liability, on any grounds, is limited to the amount paid for the relevant product. Nothing excludes the consumer’s mandatory legal rights.
14. Intellectual property
The Seller’s content, trademarks, and visuals are protected. Any unauthorized reproduction or use is prohibited. Third-party trademarks (including Tesla) remain the property of their respective owners.
15. Personal data
Data processing (orders, support, invoicing) is described in the Privacy Policy. GDPR rights: access, rectification, erasure, objection, portability, restriction.
16. Force majeure
The Seller shall not be held liable for any failure to perform caused by a force majeure event (widespread network outage, natural disaster, conflict, decisions by public authorities, etc.).
17. Governing law & jurisdiction
French law, subject to the mandatory provisions of the consumer’s country of residence. Disputes shall be brought before the competent courts in accordance with applicable law.
